The Haryana Real Estate Regulatory Authority (H-RERA) has taken a significant step to address long-standing delays in property possession, issuing an order to major developers in Gurgaon to handover flats to buyers within the next three months or face serious consequences. In some cases, buyers have been waiting for more than five years to receive the homes they paid for. This bold move by H-RERA seeks to ensure that developers adhere to their commitments and uphold the rights of homebuyers.

H-RERA has specifically directed four prominent developers—Raheja Developers, Ramprastha Developers, Tashi Land Developers, and Sunrays Heights Pvt Ltd—to deliver possession within 90 days. If the developers fail to comply, they will be required to pay an annual interest of 11.1 percent on the amount invested by the buyers. The regulatory body has also issued a stern warning that any failure to follow through with the orders will result in legal action, holding developers accountable for the prolonged delays.

The decision by H-RERA follows investigations into several cases where buyers, despite making substantial payments, have yet to receive possession of their properties. For instance, in one case involving Raheja Developers, a flat in Shilas, Sector 109, Gurgaon, was purchased in 2010. However, the buyer still hasn’t received possession because the project failed to obtain the required occupancy certificate from the Department of Town and Country Planning. H-RERA has now directed Raheja Developers to deliver the property within three months and pay interest for the delay, ensuring the buyer is compensated for the extended wait.

In another case, Ramprastha Developers, which had promised possession of a flat in the Ramprastha Primera Society, Sector 37D, by 2018, has now been ordered to pay interest from February 2018until the property is handed over. Buyers who booked their flats in 2013 are still waiting for possession, despite having made their payments years ago. Similarly, Tashi Land Developers has been instructed to pay interest starting from 2015 for a flat booked in the same year in their Tashee Capital Gateway project in Sector 111, Gurgaon, which remains undelivered.

Lastly, Sunrays Heights Pvt Ltd has also received a directive from Haryana RERA regarding their Sunrays Heights 63 Golf Drive project in Sector 63A. The developer has been ordered to provide possession within 90 days and compensate buyers with interest for the delay.

The ongoing delays in property possession have been a source of immense frustration for many homebuyers, who are left in limbo after investing their hard-earned money. The intervention of Haryana RERA is an essential measure to restore accountability and trust in the real estate sector. By enforcing these strict timelines and financial penalties, the regulatory authority is taking concrete action to protect the interests of property buyers, ensuring that developers fulfill their obligations and that homebuyers are not left waiting indefinitely for what they’ve already paid for.
